Your Legal Rights in Kentucky

On top of your federal rights under the FCRA and FDCPA, Kentucky law sets its own deadlines for how long a creditor or debt collector can sue you, and its own state consumer-protection statute enforced by the Kentucky Attorney General.

How Long Can You Be Sued for a Debt in Kentucky?

  • Oral contracts and most open accounts: 5 years (KRS 413.120)
  • Written contracts signed on or after July 15, 2014: 10 years (KRS 413.160)
  • Written contracts signed before July 15, 2014, and court judgments: 15 years (KRS 413.090)

Credit-card debt is genuinely contested in Kentucky: courts have applied both the 5-year open-account period and the longer written-contract periods, depending on the account documents. Do not assume either number applies to your account without a legal review of the cardmember agreement.

The statute of limitations controls how long you can be sued — it is separate from the roughly 7-year window most negative items can stay on your credit report under the FCRA. A debt can be too old to sue on and still appear on your report, and in some situations a payment on an old debt can restart the clock.

Kentucky Consumer Protection Act (KRS 367.170)

Declares unfair, false, misleading, or deceptive acts or practices in trade or commerce unlawful in Kentucky, adding a state-level claim on top of federal law when a creditor, collector, or furnisher deceives a consumer.
